1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and NexusSentry AI ("we," "us," or "our") governing your use of Witnessed — our AI-powered condition documentation service available at witnessed.nexussentry.ai.

By creating an account or using Witnessed, you agree to be bound by these Terms.

Eligibility: You must be at least 18 years old to use Witnessed.

2. Service Description

What Witnessed IS:

• ✅ Photo-based condition documentation — you upload photos at move-in / pick-up / check-in and at move-out / return / check-out
• ✅ AI-powered analysis — AI analyzes uploaded photos and generates structured observations and condition summaries
• ✅ Timestamped condition records — documented record of visible condition at the time of inspection
• ✅ Before-and-after comparison — automated side-by-side condition assessment for move-out or return
• ✅ Downloadable PDF reports — shareable condition reports for landlords, tenants, renters, and vehicle owners

What Witnessed IS NOT:

• ❌ Not legal advice — Witnessed is not a law firm and does not provide legal opinions
• ❌ Not a dispute arbitrator — we do not adjudicate claims or decide liability
• ❌ Not an insurance product — reports do not constitute insurance claims or coverage
• ❌ Not a substitute for professional inspection — reports are informational and should supplement, not replace, professional assessments where required
• ❌ Not a guarantee of accuracy — AI-powered reports are designed to help users document visible conditions and should be reviewed before being relied upon

Intended Use:

Witnessed is intended solely for documenting the visible condition of legitimate properties and physical assets. Uploading unrelated images or using the service for purposes other than condition documentation is prohibited.

Inspection Coverage:

Witnessed analyzes only the photographs you provide. Areas that are not photographed cannot be evaluated. Users are responsible for ensuring sufficient photographic coverage of the property or asset being inspected.

Photo Quality:

Report quality depends on the quality, lighting, completeness, and accuracy of the photographs you provide. Blurry, dark, incomplete, or inaccurate photographs may result in incomplete or inaccurate condition observations.

Image Alteration:

Witnessed does not verify whether uploaded photographs have been edited, filtered, enhanced, or otherwise modified before upload. Users are solely responsible for ensuring uploaded images accurately represent the condition of the property or asset at the time of inspection.

Visible Condition Only:

Witnessed evaluates only visible conditions shown in uploaded photographs. It does not detect hidden, structural, mechanical, electrical, plumbing, mold, pest, safety, or other latent defects not visible in the photographs provided.

No Verification of Authenticity:

Witnessed does not independently verify that uploaded photographs accurately depict the claimed property, asset, date, time, or condition. Users are solely responsible for ensuring photographs accurately represent the condition of the property or asset at the time of inspection.

Report Metadata:

When available, reports may include metadata such as capture time, upload time, approximate location, and basic device metadata. Metadata may be unavailable, incomplete, altered, or removed depending on the device, operating system, camera settings, or image editing performed before upload.

Supported Inspection Types:

Witnessed supports condition documentation for physical assets and properties including, but not limited to, residential apartments, short-stay rentals, property viewings, rental vehicles, vessels, storage units, and equipment rentals. Additional asset types may be supported over time.

3. Pricing & Payment

Witnessed uses pay-per-inspection pricing. There are no monthly subscriptions. You pay only when you unlock a report.

Prices are in USD and are subject to change. Purchasing unlocks ongoing access to the report, subject to these Terms and our Privacy Policy.

Refunds:

Because AI analysis is consumed at the time of purchase, all sales are final. If you experience a technical failure that prevents report delivery, contact us at support@nexussentry.ai and we will investigate and provide a remedy at our discretion.

4. User Responsibilities

You Are Responsible For:

• ✅ Ensuring you have the right to photograph the property or asset being inspected
• ✅ Providing accurate inspection details — property name, inspection type, and your legal name
• ✅ Uploading photos that clearly represent the actual condition at the time of inspection
• ✅ Reviewing AI-generated observations for accuracy before relying on them
• ✅ Complying with all applicable laws and privacy regulations when photographing people or property
• ✅ Keeping your account credentials confidential

Prohibited Uses:

• ❌ Uploading photos you do not have the right to use or that depict unlawful conduct
• ❌ Fabricating or staging inspection conditions to deceive a landlord, tenant, renter, or counterparty
• ❌ Using reports to harass, defame, or make false claims against any individual
• ❌ Submitting photos of persons in private settings without their knowledge or consent
• ❌ Reselling, redistributing, or commercially licensing reports without written permission
• ❌ Using automated bots or scripts to interact with the service
• ❌ Uploading sexually explicit, pornographic, exploitative, or otherwise inappropriate content unrelated to legitimate condition documentation

5. Photo Uploads & Content

By uploading photos, you represent that:

• You own or have explicit permission to use the photos
• The photos accurately represent the condition of the property or asset at the time shown
• The photos have not been edited, filtered, or otherwise altered to misrepresent the actual condition
• The photos are related to a legitimate property or asset inspection
• The photos do not contain illegal content

You retain all rights to your photos. By uploading, you grant Witnessed a limited, non-exclusive license to process the photos through AI analysis solely for the purpose of generating your inspection report. We do not use your photos to train AI models.

5a. Third Party Privacy:

When photographing a property or asset, you are responsible for ensuring that any visible personal belongings, artwork, documents, or identifying information of third parties is either obscured or that you have permission to photograph it. Witnessed is not responsible for privacy claims arising from content visible in your uploaded photos.

5b. Prohibited Content:

You may not upload, submit, or process content that:

• Contains sexually explicit or pornographic material
• Contains child sexual abuse material (CSAM) or exploits or depicts minors in a sexual context
• Contains graphic violence, gore, or extreme violent content unrelated to a legitimate property or asset inspection
• Promotes or facilitates illegal activity
• Infringes the intellectual property or privacy rights of others
• Contains malware, harmful code, or other technically damaging content
• Is unrelated to the legitimate documentation of a property or physical asset

Witnessed reserves the right to remove prohibited content, suspend or terminate accounts, and report suspected illegal content to appropriate authorities where required or permitted by applicable law.

6. Content Moderation

We reserve the right, but are not obligated, to review uploaded content using automated systems or human review for the purpose of detecting abuse, fraud, illegal content, security threats, or violations of these Terms.

We may remove content, suspend accounts, or terminate access without notice where we reasonably believe a violation has occurred. Users whose accounts are terminated for violations of Section 5b may have their accounts permanently terminated at our sole discretion.

7. Guest Access

You may start an inspection without creating an account using guest mode.

• Guest inspections remain available for 30 days unless the user creates an account
• Creating an account permanently associates the inspection with that account
• Paid reports are retained until deleted by the user, subject to our data retention policy

We strongly recommend creating an account to ensure long-term access to your condition records. Guest inspections that are not associated with an account within 30 days will be permanently deleted.

8. Account Management

• You may close your account at any time by contacting support@nexussentry.ai
• Upon account closure, paid inspection records are retained for 30 days before permanent deletion
• We may suspend or terminate accounts for material violations of these Terms

9. Acceptable Use

You may NOT:

• Reverse engineer, decompile, or copy any part of the Witnessed service
• Bypass authentication or access controls
• Create multiple accounts to evade usage restrictions
• Interfere with other users' access to the service
• Upload content prohibited under Section 5b of these Terms

10. Intellectual Property

We own all rights to the Witnessed platform, software, algorithms, workflows, branding, and related intellectual property. You retain all rights to your uploaded photos and personal data. The condition reports we generate for you may be used freely for their intended personal and professional purposes.

11. Third-Party Services

Witnessed relies on third-party services including:

• AI Service Providers — OpenAI and other AI service providers may be used to analyze uploaded photos and generate condition observations and summaries. The AI providers we use do not use our API-submitted data to train their models unless otherwise stated.
• Stripe — payment processing for report unlocks. We do not store payment card details.
• Cloud infrastructure — secure encrypted storage for inspection data.

We may change or replace third-party providers without notice, provided doing so does not materially reduce the protections described in these Terms or our Privacy Policy.

We are not responsible for failures or changes in third-party services.

12. Service Availability

Witnessed is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee uninterrupted service, error-free AI analysis, or that reports will be accepted by any third party.

13. Limitation of Liability

WE SHALL NOT BE LIABLE FOR:

• ❌ Indirect, incidental, or consequential damages
• ❌ Outcomes of legal disputes, insurance claims, or deposit deductions based on our reports
• ❌ AI analysis errors, omissions, or misidentifications
• ❌ Loss of inspection data due to account inactivity or technical failure
• ❌ Third-party service disruptions (AI providers, Stripe, cloud providers)

For the avoidance of doubt: We are not liable for the outcome of any deposit dispute, damage claim, insurance determination, or legal proceeding in which a Witnessed report is used as documentation, regardless of the accuracy or completeness of the AI-generated observations and summaries.

14. Indemnification

You agree to indemnify and hold harmless NexusSentry AI and its affiliates from any claims arising from:

• Your use or misuse of the Witnessed service
• Your violation of these Terms
• Any false, misleading, or unauthorized condition reports you generate
• Your violation of any applicable laws or third-party rights
• Any prohibited content you upload in violation of Section 5b

15. Dispute Resolution

Informal Resolution: Contact support@nexussentry.ai before filing any formal claim. We aim to resolve issues within 5 business days.

For US Users: Disputes shall be resolved by binding arbitration under AAA rules. All claims must be brought individually — no class actions.

Note: The enforceability of arbitration clauses and class action waivers varies by state. Users in California and certain other states may have additional rights under applicable law.

16. Force Majeure

We are not liable for failures due to circumstances beyond our control, including natural disasters, acts of government, third-party service outages, or cyberattacks.

17. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email with 30 days' notice.

18. Governing Law

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.
